Background Check After a DUI


One of the most common questions we hear after a DUI arrest is: Will this show up on a background check?

The short answer is yes.

In Georgia, DUI is what’s called a fingerprintable offense. That means when you’re arrested, your fingerprints are taken and a record of that arrest is created. That information is sent to the State of Georgia and entered into a national database. As a result, a background check will reflect that there was an arrest for a misdemeanor traffic offense — DUI.

It’s important to understand that the record of the arrest itself does not simply disappear. There will always be a record that the arrest occurred.

What we focus on, however, is preventing a conviction.

Another concern we often hear involves job applications. Employers sometimes ask two separate questions:

  • “Have you ever been arrested?”

  • “Have you ever been convicted?”

If your DUI case is still pending and you are asked whether you have been arrested, the truthful answer is yes.

If you are asked whether you have been convicted, and your case is still pending, the answer is no.

Understanding that distinction is critical. An arrest and a conviction are not the same thing — and how your case is resolved can make a significant difference in what ultimately appears on your record.
