A landmark Channel 2 investigation confirms what Clemson researcher Dr. Spurgeon Cole proved in 1994 — and what Atlanta DUI attorney Greg Willis has been arguing in courtrooms ever since.
A recent Channel 2 Action News investigation by Justin Gray revealed that 701 Georgians charged with DUI in 2025 were proven by GBI blood tests to have had zero alcohol and zero drugs in their system. Completely sober. Still arrested.
I am not surprised. For thirty years I have argued in Georgia courtrooms that field sobriety tests are not reliable evidence of impairment. The science has always backed that up.
In 1994, Clemson researcher Dr. Spurgeon Cole confirmed that 46%of completely sober individuals — confirmed at 0.00 BAC — were judged “too drunk to drive” by trained law enforcement officers watching them perform standard field sobriety tests. Nearly half. All sober. His conclusion: the tests do not reliably distinguish between impaired and unimpaired people.
Even without alcohol, the number of errors made by individuals performing the field sobriety tests was sufficient for officers to judge that the individuals had had too much to drink.
