Atlanta Criminal Trial Attorney Greg Willis Testifying in front of the Georgia House of Representatives
Atlanta Driver’s License Suspension Lawyers
Georgia operates a dual-track system for DUI consequences: the criminal case (handled by the courts) and the administrative license action (handled by the Georgia Department of Driver Services, or DDS). These are separate proceedings, and you can lose your license in the administrative proceeding even if you are acquitted of the criminal DUI charge.
The 30-Day Rule: Under O.C.G.A. § 40-5-67.1, you have exactly 30 calendar days from the date of your DUI arrest to request an ALS hearing with the DDS. If you miss this deadline, your license will be automatically suspended — period. There are no extensions, no exceptions, and no way to undo the suspension once the window closes.
What Willis Law Firm does: We file your ALS hearing request immediately upon retention — typically within 24–48 hours. We appear at the ALS hearing and challenge the administrative suspension. Even if we cannot prevent the suspension entirely, we work to minimize its duration and secure a limited driving permit (hardship permit) as quickly as possible.
License Suspension Durations: First DUI — 120-day ALS suspension; Second DUI within 10 years — 3-year suspension; Third/felony DUI — 5-year or permanent revocation.
