DUI Penalties in Georgie – What You Face
First DUI (misdemeanor): 24 hours to 12 months in jail (typically 24 hours minimum); fines of $300–$1,000 plus surcharges; 12 months probation; 40 hours community service; DUI Alcohol or Drug Use Risk Reduction Program (DUI School); license suspension of 120 days with limited permit available after 30 days; clinical evaluation; possible ignition interlock device.
Second DUI (within 10 years): Minimum 72 hours in jail; fines of $600–$1,000 plus surcharges; license suspension of 3 years (limited permit after 120 days); mandatory 30 days of community service; ignition interlock required for 12 months after reinstatement.
Third DUI (within 10 years): Felony if third within 10 years in some circumstances; mandatory 15 days in jail; fines up to $5,000; 5-year license suspension; mandatory publication of name/photo in newspaper.

Most misdemeanor DUI cases in Georgia resolve within 6 to 18 months. Cases that go to trial or are transferred to State Court take longer. Starting with the right attorney minimizes delay and maximizes your options.
Georgia’s expungement law (record restriction) is very limited for DUI convictions. A DUI conviction that results in a ‘guilty’ or ‘nolo contendere’ plea is generally not eligible for record restriction. This is one reason why fighting the charge — not pleading guilty quickly — matters so much.
Refusal triggers an automatic administrative license suspension, separate from the criminal DUI case. You have 30 days to request a hearing. On the criminal side, the state will try to use your refusal as evidence. A man named John was charged with DUI after being pulled over for swerving on the road. At the time of the stop, the officer administered a breathalyzer test and John registered a BAC of 0.10%, above the legal limit of 0.08% in Georgia. John was arrested and charged with DUI.
John hired our experienced DUI attorney in Atlanta to represent him in court. Attorney Greg Willis reviewed the evidence in the case and discovered that the officer had not followed proper procedures in administering the breathalyzer test. Attorney Willis also discovered that the breathalyzer device used by the officer had not been calibrated correctly.
At trial, Attorney Willis argued that the results of the breathalyzer test should not be admissible as evidence because the test was not conducted properly. Attorney Willis also presented evidence that John had a medical condition that could have affected the results of the breathalyzer test.
The judge agreed with the defense’s argument and excluded the results of the breathalyzer test from the trial. Without this key piece of evidence, the prosecution’s case was weakened — and the jury found John not guilty of DUI.
